Who Is Responsible When Several Drivers Share Fault in Lebanon, TN?
In Tennessee, each at-fault driver is generally responsible only for the percentage of fault assigned to that driver, rather than for the whole amount of the loss. That rule is known as several liability. Because of it, an injured person’s recovery can depend on identifying every driver who may share responsibility and each driver’s insurance coverage.
That matters because the percentages are decided case by case, and the insurer for one driver may point toward another. Police reports, photographs, witness statements, and vehicle damage patterns all help show how each vehicle moved.
Tennessee generally allows one year from the date of injury to file a lawsuit, and when a defendant blames a driver who has not been named, the law can allow a short window, often 90 days, to add that driver. That exception depends on the circumstances and is not something to count on.
Sorting out which insurer owes what takes time, especially when each company has its own view of fault. A car accident lawyer can help identify every driver who may share responsibility, request the relevant policy information, and keep the filing deadline on the calendar while the injured person focuses on recovery.
