How Insurance Claims Work After a Crash in TennesseeTwo-Vehicle Injury Crash at Old Nashville Hwy & Cedar Forest Dr

After a crash in Tennessee, injured people typically file a claim with the at-fault driver’s insurance company to seek compensation for medical expenses, lost wages, and other losses. Tennessee follows a fault-based system, meaning the driver who caused the accident is generally responsible for covering the damages that result from the collision.

Once a claim is filed, the insurance company will assign an adjuster to review the details of the crash. The adjuster’s job is to evaluate the claim and determine how much the insurer is willing to pay. It is important to understand that insurance adjusters work for the insurance company, not for the injured person. Their goal is often to settle claims quickly and for as little as possible.

Injured people have the right to decline an initial settlement offer if it does not fully cover their losses. Medical treatment for crash injuries can be costly, and some injuries require ongoing care that extends well beyond the initial hospital visit. Accepting a settlement too early can leave a person without enough funds to cover future medical expenses or lost income. Consulting an attorney before accepting any offer helps ensure a person understands the full value of their claim.

Rear-end collisions can cause injuries that are not immediately obvious. Whiplash, back pain, and soft tissue injuries often develop or worsen in the days following a crash. Seeking medical attention promptly after an accident creates a medical record that connects those injuries directly to the collision, which strengthens an insurance claim and any potential legal case.

Tennessee also applies a modified comparative fault rule to personal injury claims. Under this rule, an injured person can still recover damages as long as they are less than 50 percent at fault for the accident. However, any compensation awarded is reduced by the injured person’s percentage of fault. A car accident attorney can help evaluate how this rule might apply to a specific situation and work to build a clear picture of what happened.

Documentation plays a critical role in the claims process. Police reports, medical records, photos of the vehicles and scene, and witness statements all help support a claim. Keeping organized records of every medical visit, expense, and communication with the insurance company makes the process easier to manage and harder for insurers to dispute.
