Who Pays for Damages After a Rollover Crash in Murfreesboro, TN?
Tennessee follows a fault-based system for auto accidents, in which the driver responsible for causing a collision is generally liable for the resulting damages, including vehicle repair costs, medical bills, and lost income.
Rollover crashes tend to lead to more serious injuries than standard collisions, including spinal trauma, head injuries, and extended extrication times, all of which can affect the type and amount of documentation an insurance company expects. Someone who was trapped inside a vehicle may also need ongoing treatment for injuries that aren’t fully apparent until days later.
Tennessee applies a modified comparative fault rule, so a person can still recover damages as long as they’re found less than 50% responsible for the collision. A car accident lawyer can help determine which driver bears responsibility by reviewing the police report, any available dashcam footage, and statements from those involved, since fault in a rollover crash isn’t always immediately clear from the vehicles’ final positions alone.
Because insurance companies usually move quickly to assign blame after a rollover, having accurate information early can matter a great deal. At Gritton & Gritton, we can help victims sort through fault determination and next steps after a crash like this one.
