How Long Do Injured Drivers Have to File a Lawsuit in Smyrna, TN?
In Tennessee, most personal injury lawsuits must be filed within one year of the date of the injury. That is shorter than the deadline in many other states, and if a person missed it, they can be barred from filing a claim entirely. Some exceptions may extend the time, but they depend on the facts, so nobody should count on one.
The one-year period usually starts on the day the injury happened. If an injury was not reasonably discoverable right away, the start date may shift. Tennessee law may also pause the clock for a child until age 18. Ongoing talks with an insurer generally do not stop the deadline from running, which is why the date usually arrives faster than people expect.
To build a strong claim, evidence such as records, bills, photos, and witness names take time to collect. A car accident lawyer can help gather them, track the filing date, and decide when a lawsuit should be filed.
