How Long Do Drivers Have to File an Injury Lawsuit in Smyrna, TN?Crash Causes Injuries on Industrial Blvd

Tennessee generally gives drivers one year from the date of injury to file a personal injury lawsuit, which is shorter than the deadline in many other states. If they miss that date, they can end a claim, no matter how strong the evidence is. Some exceptions can pause or extend the deadline, but they are narrow.

Additionally, insurance negotiations do not usually stop that clock. An insurer may take months to review medical records and make an offer, and a claim still being discussed when the deadline passes may not be able to move forward in a lawsuit. Property damage claims follow a separate, longer deadline, so the two can run on different schedules.

Many drivers navigating the aftermath of a crash turn to a car accident lawyer to help calculate the filing date, gather records before the deadline gets close, and explain which exceptions may apply to a particular situation.

If you have been injured in a car accident, you don’t have to sort through these aspects alone. At Gritton & Gritton, we are available to speak with you and help you understand what timelines may apply to your case and what steps may be one for you under Tennessee law.
