How Long Do You Have to File an Injury Claim in La Vergne, TN?
In most cases, one year. Tennessee gives people one year from the date of an injury to file a personal injury lawsuit, one of the shortest deadlines in the country. Missing it usually ends the chance to seek compensation in court, even when the other driver was clearly at fault.
A few exceptions can change that timeline. If the at-fault driver is charged with certain crimes, like DUI or vehicular assault, the deadline is generally extended to two years. For children, the clock usually doesn’t start until they turn 18. Claims for vehicle damage alone have a longer three-year limit, but that extra time doesn’t apply to injuries.
One year goes by faster than many people expect. Medical treatment, missed work and back-and-forth with insurers can fill several months, and settlement talks don’t pause the deadline. An adjuster may keep negotiating until the window is nearly closed.
In these cases, talking with a car accident lawyer early can help confirm the exact deadline, gather records while they are easy to get, and get a lawsuit filed in time if an accident claim doesn’t settle.
Tennessee’s one-year deadline leaves little room for delay after a crash. At Gritton & Gritton, we can review your timeline and explain which deadline may apply to your claim.
